Submission to Attorney General: Family Law Act modernization

CBABC has responded to Phase 2 of the B.C. government’s review to modernize the Family Law Act.

Our recommendations, which concern care of children and protection from family violence, include:

  • Implement a process to help ensure continuity of care
  • Help guardians authorize someone to exercise parental responsibilities on their behalf
  • Align the contact provisions in the Family Law Act with the Divorce Act
  • Consider and respect Indigenous perspectives and traditions in resolving family disputes

Led by our Family Law Committee, the development of this submission also draws from the expertise of members of CBABC Family Law Sections, Children’s Law Section and Truth & Reconciliation Committee.

Improving family law across the province is a vital part of CBABC’s Agenda for Justice 2021. We continue to advocate for the establishment of a Unified Family Court to reduce the time and costs from the current two-court system.
