Meeting Title/Topic: Recent Amendments to the Evidence Act, RSBC 1996, c. 124: Introducing Limitations on the Use of Experts in Vehicle Accident Claims
Synopsis: Following the decision of the Honourable Chief Justice Hinkson in Crowder v. British Columbia (Attorney General), 2019 BCSC 1824 striking down amendments to Rule 11-8 of the Supreme Court Civil Rules, B.C. Reg. 168/2009 limiting experts in vehicle accident claims, the Government has enacted changes to the Evidence Act, RSBC 1996, c. 124 again limiting the number of experts used in vehicle accident claims. In this presentation, we heard from John Rice, current president of and counsel for the Trial Lawyers Association in the Crowder decision, and Krista Prockiw, Manager of Claims Legal Programs for ICBC, as they discussed the amendments to the Evidence Act and their potential effect on the clients they represent.
