Synopsis: Non-disclosure agreements are contracts originally created to protect trade secrets. When used wrongly, these agreements can become secret settlement contracts used to buy the silence of a victim or whistleblower. They have become the default solution for organizations, corporations and public bodies to settle cases of sexual misconduct, racism, pregnancy discrimination and other human rights violations.
Dr. Julie Macfarlane, Jennifer Khor and Clea Parfitt discuss the roots of the problem, describe some of the harms being perpetuated, and update attendees on the advocacy and legislative efforts being made both nationally and internationally in various jurisdictions to address this serious matter.
