CRIM 11 Scheduling Conflicts Between Provincial Court and the Supreme Court

With the increased pressure on completing trials without undue delay created in the wake of the Supreme Court of Canada’s decision in R. v. Jordan, it has become necessary to set out some guidelines to govern scheduling conflicts which arise between the Provincial Court and the Supreme Court.

This Practice Direction sets out standard directions governing the conduct of appeals from decisions of masters, registrars or special referees. If the circumstances of an appeal require, the timelines and document filing requirements set out in this Practice Direction may be abridged, extended or modified by order of a justice of the court pursuant to Supreme Court Civil Rule 22-4(2) and Supreme Court Family Rule 21-2(2).

PD - 50 Masters' Jurisdiction

This Practice Direction has two parts. Part A sets out a direction of the Chief Justice pursuant to Section 11(7) of the Supreme Court Act , R.S.B.C 1996 c. 443, as to the matters in respect of which a master is not to exercise jurisdiction. Part B sets out guidelines for the assistance of the profession and the public as to the matters in respect of which a master has jurisdiction.
