Message to Members: Legal Professions Act passed

As you are likely aware, Bill 21 received Royal Assent on May 16 with only 30 of its 317 clauses debated. The legislation will bring lawyers, notaries and paralegals under one regulator.

Despite multiple calls to allow legal professionals and the public more time to provide input on the Bill, it was passed without addressing the significant issues raised by lawyers. As a result, the Law Society of BC has initiated litigation and we expect to intervene in that court action.

Since the Bill was introduced on April 10, CBABC held 13 consultation sessions with lawyers and articling students (among our 8,000 members) – including members of our Aboriginal Lawyers Forum, Truth & Reconciliation Committee and Provincial Council. This enabled us to gather the views of lawyers across the province.

As we outlined in our letter to the Attorney General on May 14, we supported some components of the legislation, such as creation of an Indigenous Council, but there are fundamental flaws that should have been addressed before its passing. Read the letter ❯

So, what happens next? A transition board will be established, and the Law Society of BC will continue to regulate lawyers for the time being. Unless there is an injunction or other court order, transitioning to the new regulator is expected to take approximately 18 months.
