Enhancing the Early Resolution Process

On July 15, CBABC delivered a letter to the Ministry of Attorney General and the Superior Courts regarding improvements to the Early Resolution Process for family law matters.

While the ERP has helped families obtain early legal support and reduced remand delays, more can be done to improve consistency and transparency across registries. Gaps in access to legal advice and family violence screening should also be addressed.

Our recommendations include:

  • Ensure ERP agreements align with court-ordered outcomes
  • Address delays and equity concerns
  • Improve access to legal advice and trauma-informed support
  • Strengthen cultural competency and family violence screening protocols

This advocacy is led by our Family Law Committee, which gathered firsthand perspectives on ERP in practice from family law practitioners and the Ministry of Attorney General’s Family Justice Services Division.
