On January 27, CBABC responded to the BC Supreme Court Civil and Family Rules Committee’s consultation on the costs regime for civil matters. We appreciate the Rules Committee’s work to modernize the civil tariff and simplify cost assessments.
Members broadly support simplifying and periodically reviewing the civil tariff, along with adjusting costs in response to inflation. However, concerns remain around whether the proposed amounts will encourage early resolution or deter unmeritorious claims.
We also emphasized that complementary mechanisms, such as lump sum costs and payment forthwith on interlocutory applications, are essential to maintaining a responsive and current costs regime.
CBABC conducted engagement sessions with lawyers across B.C. to inform this submission.
