Update
On June 5, the B.C. government responded to CBABC’s submission, expressing appreciation for our engagement and support regarding the Land Title and Property Law Amendment Act, 2024.
Amendments to the Land Owner Transparency Regulation, BC Reg. 250/2020 clarify:
- First Nations limited partnerships will be exempt from mandated reporting under LOTA;
- Tribal Councils will be included in the definition of “First Nations”; and
- Any First Nation as defined under the Land Title Act will be exempt from filing requirements under LOTA.
These came into force on May 21, 2024.
On April 19, CBABC delivered a letter to the Government of BC offering support for the passing of Bill 13, the Land Title and Property Law Amendment Act, 2024. The Act will enable First Nation registration of land in the LTSA’s Land Title Office.
As the legislation is implemented, we asked that government consider:
- Whether First Nations limited partnerships are exempt from mandated reporting under the Land Owner Transparency Act
- If the definition of “First Nations” includes tribal councils
- How First Nations may document their lands in the Land Registry moving forward
These changes are significant in moving DRIPA forward and therefore require ongoing engagement and consultation with the stakeholders involved.
The legislation comes into force on May 21, 2024.
