Meeting Title/Topic: Refresher on the Law of Privilege
Synopsis: The law of privilege is important to all areas of practice (not just litigation!). Codie Chisholm and Catherine Whitehead review the scope and content of, and the exceptions to, the class privileges relevant to commercial practice and commercial litigation (solicitor/client privilege; litigation privilege; and settlement privilege). They share how case-by case privilege is established, how privilege can be waived (and by whom), and so-called “common interest privilege” and how it can extend privilege to additional parties with a common interest. They also cover the basics for those that are new to the topic (and those who need a refresher), but discuss strategy and new developments for the more advanced attendees.
