Effective January 27, 2026, BCLI has released the Study Paper on Access to Neighbouring Land and Airspace for Construction-related Purposes.
This study paper addresses a common issue in urban settings where developers and their contractors need access to the land and airspace of neighbouring landowners to operate a construction crane or to reinforce the sides of an excavation. Disagreements between these parties about access and compensation can lead to trespasses, injunctions and stalled construction projects. The study paper offers potential solutions for the prevention and resolution of such disagreements.
