Service of Documents during the Postal Disruption

Summary:

This Administrative Notice sets out what parties and counsel may expect in civil and family chambers proceedings or at a registrar’s hearing with respect to service of documents during the disruption of Canada Post’s mail delivery services.

Direction:

  1. Parties and counsel appearing in chambers or at a registrar’s hearing who have served notice or other materials by mail during the postal disruption must be prepared to address sufficiency of service.  
  2. The presiding judge, associate judge or registrar may require evidence of service and may refuse to hear a matter if not satisfied that the opposing party has actual notice of the application or hearing.
