Sandy Carpenter and Robert Janes, KC explores one of the most significant public law decisions of the year: Kebaowek First Nation v. Canadian Nuclear Laboratories. Widely recognized as a major victory for Indigenous groups, the decision affirms that the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) is part of Canadian law and must be used to interpret Canadian law, including Section 35 and the duty to consult.
